Tobie Group, LLC (“Tobie Group,” “Tobie,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information when you visit TobieGroup.com, submit a form, receive communications from us, or otherwise interact with us online (collectively, the “Site”). It also explains certain practices that apply when we process information while providing marketing, advertising, analytics, automation, and consulting services to our business clients.
This Privacy Policy is a notice of our practices and is not a contract. Where consent is required by law, we will request it separately.
1. Who We Are
Tobie Group is a marketing and consulting firm that provides marketing strategy, digital advertising, analytics, marketing technology, automation, content, and related services to business clients.

2. Scope and Our Role
This Privacy Policy applies when Tobie Group determines why and how personal information is processed, including information collected through our Site and our own marketing activities.
In providing services to clients, we may also process advertising, analytics, customer relationship management, lead, conversion, audience, or other information on a client’s behalf. In those circumstances, the client generally determines the purposes and means of processing, and Tobie Group acts as a service provider or processor subject to the client’s instructions and our agreement with that client. The client’s privacy notice—not this Privacy Policy—governs the client’s collection and use of that information. If your request concerns information collected by one of our clients, please contact that client directly. We will assist our client as required by applicable law and our agreement with the client.
3. Information We Collect
The information we collect depends on how you interact with us.
a. Information You Provide Directly
You may provide information when you:
- Complete a contact, consultation, newsletter, event, download, or other form;
- Request a proposal or information about our services;
- Communicate with us by email, telephone, text message, social media, video conference, or another channel;
- Enter into or participate in a client, vendor, or business relationship with us; or
- Register for an event, webinar, community, or resource.
This information may include:
- Name, email address, telephone number, mailing address, company name, and job title;
- Account, communication, and contact preferences;
- Information about your organization, marketing needs, budgets, campaigns, or proposed project;
- The content of messages, form submissions, meeting notes, and other communications; and
- Any other information you choose to provide.
Please do not submit sensitive personal information through general Site forms unless we specifically request it and it is necessary for the stated purpose.
b. Information Collected Automatically
When you visit or interact with the Site, we and our service providers may automatically collect information using cookies, pixels, tags, scripts, local storage, software development kits, and similar technologies. This information may include:
- Internet Protocol (IP) address and approximate location derived from it;
- Browser type, device type, operating system, language, and device or advertising identifiers;
- Referring and exit pages, dates and times of visits, pages viewed, links or buttons clicked, and time spent on pages;
- Scrolling, cursor movement, navigation paths, form interactions, and similar website engagement information;
- Advertising impressions, campaign interactions, conversions, and attribution information; and
- Cookie choices and other consent or preference signals.
Some of this information may be associated with a browser, device, cookie identifier, or contact record and may be considered personal information under applicable law.
c. Information From Other Sources
We may receive information from:
- Advertising, analytics, social media, and technology platforms;
- Marketing automation, customer relationship management, email, scheduling, event, and lead-generation providers;
- Our clients, vendors, referral partners, and other business partners;
- Publicly available sources and professional directories; and
- Other parties at your direction or with your authorization.
This information may include contact and business information, campaign and engagement data, lead or conversion information, social media interactions, and audience or interest information provided by advertising platforms.
d. Client Services Data
In the course of providing services, we may access or process data from client websites, advertising accounts, analytics properties, customer relationship management systems, call-tracking systems, marketing automation platforms, social media accounts, and other systems authorized by the client. Depending on the engagement, this data may include campaign settings and performance, search terms, audiences, creative assets, website activity, leads, conversions, communications, contact information, sales or revenue data, and attribution information.
We process Client Services Data to provide the services requested by the client and for related purposes described in our agreement with that client. We do not use one client’s nonpublic data to market another client.
4. How We Use Information
We may use personal information to:
- Operate, maintain, secure, troubleshoot, and improve the Site and our services;
- Respond to inquiries, schedule meetings, prepare proposals, and provide requested services;
- Manage client, prospect, vendor, and business relationships;
- Send newsletters, articles, event invitations, service information, and other marketing communications, subject to applicable law;
- Personalize communications and maintain contact preferences;
- Analyze website use, campaign performance, user behavior, lead quality, conversions, attribution, and marketing effectiveness;
- Create, manage, test, measure, and optimize advertising campaigns, including retargeting and audience campaigns;
- Develop reports, forecasts, recommendations, content, creative concepts, and marketing strategies;
- Detect fraud, misuse, security incidents, technical problems, and violations of our terms or policies;
- Protect our rights, property, safety, systems, clients, and users;
- Establish, exercise, or defend legal claims; and
- Comply with applicable laws, regulations, contracts, and legal processes.
5. Artificial Intelligence and Automated Tools
We use artificial intelligence, machine learning, and other automated tools in our business and in providing services to clients. These tools may analyze information from our Site, our advertising and analytics accounts, and systems or accounts that clients authorize us to access.
Depending on the task and client engagement, AI-assisted processing may include:
- Summarizing website, advertising, analytics, lead, conversion, or sales information;
- Identifying patterns, trends, anomalies, opportunities, or potential data-quality issues;
- Supporting attribution analysis, forecasting, reporting, audience analysis, and campaign optimization;
- Drafting or refining reports, recommendations, strategies, advertising copy, content, and creative concepts;
- Organizing, classifying, matching, or extracting information; and
- Automating routine marketing and operational workflows.
Information processed by AI tools may include campaign and account data, website and engagement data, business information, communications, creative materials, and, where appropriate and authorized, personal information contained in client systems. We may use third-party AI and technology providers to perform these functions. Those providers may process information on our behalf or under their own applicable terms, depending on the service and configuration.
We take reasonable steps appropriate to the context to limit the information provided to AI tools, avoid unnecessary personal information, apply available privacy and security settings, and review AI-assisted work before relying on it for material decisions. AI-generated outputs may be incomplete or inaccurate and are subject to human review where appropriate.
Tobie Group does not use AI on the Site to make decisions that produce legal or similarly significant effects about Site visitors, such as decisions concerning employment, credit, housing, insurance, or eligibility for essential services.
6. Cookies, Analytics, Session Replay, and Advertising Technologies
We use cookies and similar technologies for the following categories of purposes:
- Strictly necessary: to operate, secure, and provide essential Site functions;
- Functional: to remember settings and improve Site functionality;
- Analytics and performance: to understand how the Site is used and improve its content and performance; and
- Advertising and targeting: to measure campaigns, build or use audiences, limit repetition, personalize advertising where permitted, and show Tobie Group advertising on other sites or platforms.
The specific technologies used may change over time. They currently include or may include:
Google Analytics 4 and Google Ads
We use Google Analytics 4 (GA4) to understand Site traffic and engagement and may use Google Ads tags or related Google advertising features to measure conversions, create audiences, and deliver or evaluate advertising. Google and Tobie Group may use first-party cookies or identifiers together with Google advertising cookies or identifiers for measurement, attribution, remarketing, and related advertising purposes. Meta Advertising Technologies
We use Meta advertising technologies, which may include the Meta Pixel and related conversion or audience tools, to measure activity, understand the effectiveness of advertising, create or use audiences, and deliver ads on Facebook, Instagram, and other Meta services. Meta may receive information about your browser or device and actions taken on the Site. Information about Meta’s practices is available in the Meta Privacy Policy.
Microsoft Clarity
We use Microsoft Clarity to understand how visitors use and interact with the Site through behavioral metrics, heatmaps, and session replay. Clarity may capture page visits, clicks, scrolling, cursor movement, navigation, device and browser information, and similar interaction data using cookies and other technologies. We use this information for Site improvement, troubleshooting, analytics, security, and advertising measurement. Other Advertising Platforms
We may use tags, pixels, or similar tools from LinkedIn or other advertising platforms to measure campaigns, create audiences, and deliver advertising. The technologies actually active on the Site may change as our marketing programs change.
Marketing Automation and Customer Relationship Management
We use GoHighLevel and may use other customer relationship management and marketing automation services to collect and manage form submissions, contact records, appointments, communications, lead status, campaign activity, and follow-up workflows. Email Delivery and Measurement
We use Brevo and may use other email providers to deliver newsletters, transactional messages, and marketing communications. Emails may contain tracking pixels and instrumented links that tell us whether a message was delivered, opened, or clicked and may provide related device, browser, IP address, date, and time information. We use this data to operate email campaigns, understand engagement, improve communications, and maintain security. Information about Brevo’s practices is available in its Privacy Policy.
7. Retargeting, Targeted Advertising, and “Sale” or “Sharing”
After visiting our Site, you may see Tobie Group advertising on other websites, apps, or platforms. Advertising partners may use cookies, pixels, device identifiers, and similar technologies to associate activity across websites, apps, browsers, or devices and to deliver or measure advertising.
We do not sell personal information in exchange for money. However, some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough that making identifiers or internet activity available to advertising partners through cookies or pixels may fall within those definitions. Where applicable law gives you the right to opt out of those practices, you may exercise that right using the methods described below.
We do not knowingly sell or share the personal information of individuals under 16 years of age.
8. Your Privacy and Communication Choices
Cookie Choices
The Site does not currently offer a site-level cookie preference center. You can control or delete cookies through your browser settings. Most browsers allow you to block cookies, receive a notification when a cookie is set, or delete stored cookies. Blocking cookies may affect Site functionality, and browser settings may not control technologies that operate differently from cookies.
Advertising Choices
You may manage personalized advertising through tools provided by advertising platforms, including:
- Google My Ad Center;
- Google Analytics Opt-out Browser Add-on;
- Meta Ad Preferences; and
- Digital Advertising Alliance Opt-Out Tool.
These tools are provided by third parties and may not eliminate all advertising.
Browser-Based Opt-Out Signals
The Site is not currently configured to respond automatically to browser-based universal opt-out preference signals, such as Global Privacy Control. You may still use your browser settings, the advertising-platform controls listed above, or contact us to submit a privacy request. If we become legally required to recognize a particular browser-based signal, we will update our practices and this Privacy Policy as appropriate.
Email Choices
You can opt out of marketing emails by selecting the unsubscribe link in an email, replying with a removal request, or contacting us at hello@tobiegroup.com. We may still send nonpromotional messages, such as responses to your requests and communications concerning an existing business relationship.
Text Messages
If you consent to receive marketing text messages from us, you may opt out by replying STOP. Consent to marketing text messages is not a condition of purchasing services. Message and data rates may apply. We may continue to send nonmarketing messages when permitted by law.
9. How We Disclose Information
We may disclose personal information to:
- Service providers and processors that support hosting, security, analytics, advertising, marketing automation, customer relationship management, communications, email, scheduling, collaboration, data processing, artificial intelligence, and other business functions;
- Advertising, analytics, and social media partners for measurement, attribution, audience, retargeting, and targeted-advertising purposes as described in this Privacy Policy;
- Clients and authorized client personnel when information relates to services we provide for that client;
- Professional advisors such as attorneys, accountants, auditors, insurers, and consultants;
- Government authorities, courts, law enforcement, and other parties when we believe disclosure is required by law or reasonably necessary to protect rights, safety, property, systems, or users;
- Parties to a business transaction in connection with a proposed or completed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction; and
- Other parties at your direction, with your consent, or as otherwise disclosed when the information is collected.
Where required or appropriate, we use contracts designed to require service providers to protect personal information and process it only for permitted purposes. Some third-party advertising and analytics partners may independently determine how they process information under their own privacy policies.
We may use and disclose information that has been aggregated or de-identified so that it cannot reasonably be linked to an individual. We do not attempt to re-identify data that we maintain as de-identified unless permitted by law to test our de-identification methods.
10. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, manage business relationships, maintain records, resolve disputes, enforce agreements, satisfy legal, accounting, tax, and reporting requirements, and protect our systems and rights.
Retention periods vary based on the type and sensitivity of information, the purposes for which it is used, contractual requirements, legal obligations, and technical or operational needs. We may retain information in backups for a limited period after deletion from active systems. When information is no longer reasonably needed, we may delete, de-identify, or aggregate it, subject to applicable law.
Client Services Data is retained in accordance with the applicable client agreement, client instructions, and legal requirements.
11. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. No security measure or method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- Confirm whether we process your personal information and access that information;
- Request correction or deletion of personal information;
- Obtain a portable copy of certain personal information;
- Opt out of the sale or sharing of personal information, targeted advertising, or certain profiling;
- Restrict or object to certain processing;
- Withdraw consent where processing is based on consent;
- Limit certain uses or disclosures of sensitive personal information; and
- Appeal our decision concerning a privacy request.

We may take reasonable steps to verify your identity and authority before fulfilling a request. We may ask an authorized agent to provide proof of authorization and may need to verify your identity directly. We will not discriminate against you for exercising applicable privacy rights. If we deny a request and your law provides an appeal right, you may appeal by replying to our decision or emailing us with the subject line Privacy Appeal.
These rights are not absolute and may not apply in every circumstance. If Tobie Group holds information solely on behalf of a client, we may direct your request to that client.
13. Legal Bases for EEA and UK Processing
If the laws of the European Economic Area or United Kingdom apply, we process personal data under one or more of the following legal bases:
- Your consent;
- Performance of a contract or steps requested before entering into a contract;
- Our legitimate interests or those of another party, such as operating and improving our business, communicating with business contacts, securing our systems, and measuring marketing, where those interests are not overridden by your rights; and
- Compliance with legal obligations.
You may also have the right to lodge a complaint with the data protection authority where you live or work. We encourage you to contact us first so we can try to address your concern.
14. International Data Transfers
Tobie Group is based in the United States, and we and our service providers may process information in the United States and other countries. These countries may have privacy laws that differ from those where you live. Where required, we use legally recognized transfer mechanisms or other safeguards for international transfers.
15. Children's Privacy
The Site and our services are intended for businesses and adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided personal information to us, please contact us so we can take appropriate action.
16. Third-Party Sites and Services
The Site may link to websites, platforms, or services operated by third parties. Their privacy practices are governed by their own notices, and we are not responsible for their content or privacy practices. We encourage you to review their privacy notices before providing information.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, services, or legal obligations. We will post the revised policy on the Site and update the “Last Updated” date. If required by law, we will provide additional notice or obtain consent for material changes.
